As
part of the business teams of our clients, we believe
that, to be able to negotiate effectively, you must
be aware that negotiations may fail and be ready to
use adversarial problem solving techniques to attain
your goals. Our litigation team works very closely with
clients in balancing the benefits and disadvantages
of each scenario and mapping a detailed strategy for
each case. We like to share the responsibility of each
case with company management, and we firmly believe
that keeping the client informed and involved at all
times is essential to maintain an effective case management
and achieve results. We have extensive experience in
federal and local courts in handling plaintiffs and
defendants' cases dealing, among other things with the
following:
*
dealers' disputes
* business contract disputes
* sales representatives issues
* banking
* antitrust
* insurance regulatory and claims issues
* bankruptcy
* private claims concerning real estate, planning and
land use disputes
* environmental disputes between lessees/lessors, current
owners/past owners, and industrial and commercial neighbor
disputes
* government/administrative actions related to land
use permitting and environmental compliance
* labor & employment
We
have extensive hands-on experience in complex administrative
issues before federal and local agencies, and have a
network of consultants and experts to address the nonlegal
issues that cases raise. We practice considerably before
local and federal appellate courts, and the litigation
team partners are admitted to practice before the United
States Supreme Court. Our experience in commercial litigation
also has required us to become well acquainted with
alternate dispute resolution mechanisms and arbitration.
Such alternate mechanisms have also been used in environmental
administrative enforcement actions with the support
of our environmental practice group partners.
TCMR&S
has a proven and effective trial support team who works
very closely with case lead litigators and accomplish
tasks efficiently and cost effectively. Our litigators
have appeared before other forums, and when the case
has required it, they are always ready to provide litigation
support to non-local firms, conduct discovery and investigative
proceedings, depositions, and special meetings in other
jurisdictions outside Puerto Rico.
